General Terms and Conditions

These general terms and conditions define how to use the website www.homeconnect.cz (the operator of this website is Petr Veselý, ID No.: 87078015, registered office: Cíglerova 1083/18, Prague 9, Postcode: 19800), hereinafter referred to as “Homeconnect”, as well as the rights and obligations of Homeconnect as a seller and a third party as a buyer, hereinafter referred to as “Buyer”, arising from the purchase of goods through Homeconnect.

By submitting an order, the Buyer confirms that he/she has read the general terms and conditions of Homeconnect before ordering the goods and furthermore that he/she accepts the general terms and conditions of Homeconnect without reservation and undertakes to act in accordance with these general terms and conditions, which are binding on both parties.

The Buyer is obliged to provide truthful information in his/her communication with Homeconnect, including the processing of individual orders and the mandatory fields specified therein. In the event of providing false or misrepresented information, the Buyer acknowledges that the shipment with the ordered goods may not be properly delivered to the Buyer or returned to Homeconnect. In such event, the Buyer shall forfeit any right to a refund of the amount paid to Homeconnect and Homeconnect shall not be liable in any way for any false or misrepresented information provided by the Buyer.

Homeconnect reserves the right to cancel the Buyer’s order if there are compelling reasons to do so, in particular if the Buyer provides false or misrepresented information or if the Buyer violates any other provision of these General Terms and Conditions.

The Buyer’s order shall be deemed to be a proposal for a purchase contract, and confirmation of the order by Homeconnect shall be required for the conclusion of the purchase contract.  

The Consumer has the right to withdraw from the contract within a period of fourteen days without giving any reason. In the case of a purchase contract, the time limit runs from the date of receipt of the goods. If the consumer withdraws from the purchase contract, he shall deliver the ordered goods at his own expense to the contact address of Homeconnect within fourteen days of the withdrawal itself. The consumer must return the goods completely undamaged with full documentation in the number and condition in which they were delivered.

In case of withdrawal from the contract, the consumer shall contact the Help-desk support.homeconnect.cz (category – Complaints) and the matter will be resolved as soon as possible.

The buyer is obliged to take over the goods properly after the order has been sent and to inspect the goods upon receipt in order to detect any defects and damage. The Buyer shall immediately notify Homeconnect of any defects and damage discovered. Homeconnect shall not be liable for damage caused by the carrier.

In the event of a claim, the Buyer shall contact the Help-desk support.homeconnect.cz (category – Claims).

The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, ID: 000 20 869, http://www.coi.cz, is competent for the out-of-court settlement of consumer disputes arising from the purchase contract.

All goods are subject to a statutory period of 24 months, unless otherwise stated. The warranty covers only manufacturing defects. The warranty does not cover defects caused by normal wear and tear, improper use or improper storage.

By confirming the order, the Buyer further agrees to receive messages to the Buyer’s e-mail address specified in the registration. The messages sent may be of an informative or promotional nature. Homeconnect has the right to send messages to the Buyer’s e-mail address specified in the registration with its commercial communications. Messages sent in this way meet the conditions of the Act on the Regulation of Advertising No. 138/2002 Coll. and the Act on Certain Information Society Services No. 480/2004 Coll. and cannot be considered as unsolicited advertising. The Buyer is not bound to anything by the receipt of such a message. The Buyer may object to the sending of the above specified messages by replying to the sent e-mail message by including the text “DO NOT SEND” in the subject line.

All content of the www.homeconnect.cz website is subject to copyright. Copying of any website content without written permission from Homeconnect is strictly prohibited. Any use or distribution for profit of any part of the content of the www.homeconnect.cz website is strictly prohibited. Homeconnect will actively enforce its rights in the event of misuse of its intellectual property to the maximum extent permitted by applicable legislation.

The data collected by Homeconnect and all personal data of the Buyer are secured by Homeconnect for the duration of their use and are protected against misuse.

These General Terms and Conditions are defined in accordance with the applicable legislation of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code.

The content of the website www.homeconnect.cz may contain links to third party websites that are not subject to the control and reach of Homeconnect and are thus not subject to the general terms and conditions of use of Homeconnect’s website. If the Buyer visits the www.homeconnect.cz website via the links offered by third parties, the providers of those sites may use the Buyer’s information in accordance with their terms of use. Homeconnect is not responsible in any way for the terms of use of third parties.

Homeconnect’s Terms and Conditions may be updated without notice. It is the Buyer’s responsibility to verify the validity of Homeconnect’s General Terms and Conditions. These general terms and conditions are valid from 1.12.2021.
